  1. Introduction:

Please read these Terms and Conditions carefully as they govern your use of (which includes access to) Ameen’s personalized Services for providing home services, including all our websites and software applications that incorporate or link to these Terms, and any services that are made available through this application.

By signing up for, or otherwise using the application, you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, then you must not use the Ameen application or website.

 

  1. Definitions:

  • “Company”, "us", "we": means Prospair Vision SAL founding and operating Ameen.

  • “Ameen”: means the applications or website developed by the Company.

  • “User” or “Users”: means the client, service provider, or vendor; the person using the application and/or visiting the website.

  • “Service Provider”: means the User registered on “Ameen SP” application.

  • “Client”: means the User registered on Ameen application.

  • “Vendor”: means the User registered on Ameen website.

  • “Services”: means Ameen services; the type of services provided by the application or website.

  • “Terms”: means the terms and conditions.

 

  1. Acceptance of Terms:

By using or visiting Ameen you signify your agreement and consent to these Terms. If you do not agree to any of these Terms, please do not use Ameen.

Although we may attempt to notify you when major changes/ modifications are made to these Terms and Conditions, you should periodically review the most up-to-date version. The Company may modify or revise these Terms at any time, and you agree to be bound by such modifications or revisions.

 

  1. User Eligibility:

By using Ameen, you warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

 

  1. Account Creation:

To be able to benefit from the Services presented by Ameen, you must create a user account, that includes the requirements for accurate and truthful information.

Please note that Users are responsible for maintaining the confidentiality of their login credentials.

 

  1. Content:

Prohibited Content: Users may be restricted from posting or sharing content that is offensive, discriminatory, hateful, obscene, or violates any applicable laws or regulations. This includes content that infringes upon intellectual property rights, contains personal or sensitive information without consent, or promotes illegal activities.

 

Respectful Communication: Users are expected to engage in respectful and constructive communication with others. Harassment, bullying, or any form of abusive behavior is not tolerated.

Compliance with Laws: Users must comply with all applicable laws, including those related to privacy, data protection, and intellectual property rights. They should not engage in any activities that may violate legal obligations or rights.

 

Moderation and Monitoring: We may have mechanisms in place to moderate and monitor user-generated content to ensure compliance with our guidelines and policies. This may involve review processes, automated filters, or the ability for users to report inappropriate content.

 

  1. User Responsibilities:

Users are responsible for the content they generate and share on our website. They should ensure that they have the necessary rights and permissions for the content they upload and that it does not infringe upon the rights of others.

 

Users are responsible for:

  • the dissemination and use of sign-in name and passwords;

  • Authorize, monitor, and control access to and use of Ameen's account and password;

  • Promptly inform Ameen if the account or password has been compromised or if there is any other reason to deactivate a password.

  • In case the password is lost or proven to be stolen, Ameen will provide Users with a reset password page. In this case, Ameen may withhold providing you with another or substitute password until you provide satisfactory proof of your identification.

 

The Service Provider:

  • must register on the specific application.

  • is in charge of providing the necessary Services in accordance with the Terms and Conditions set forth, as well as the Privacy Policy.

  • registered to Ameen, is not employee of Ameen but an independent service provider using Ameen to register and put its profile information.

  • information retrieved or edited will be reviewed by the Company before being posted to the public. As such, Ameen may remove information that are not relevant without any liability whatsoever.

  • must provide, during the registrations’ review by Ameen, documents such as ID, practice profession proofs; in order to be able to access their accounts and start interacting with the Client.

  • may be asked to attend a physical interview and might be asked to edit the text and images until they match the required quality standards.

  • will be approved so that he/she can start to receive job requests from the Client.

  • may edit its Profile at all times and such changes might be subject to review and amendment by Ameen before uploading it on Ameen.

  • is fully responsible for the information input in its profile.

  • Any transgression of the above-mentioned obligations may result in the removal and ban of the Service Provider from Ameen.

 

The Client:

- is accountable for providing inaccurate information.

- observes the specified payment procedures while interacting with the Service Provider.

- don't post or distribute illegal content and abide by all rules and laws that may be relevant when using the platform.

 

The Vendor:

- is in charge of listing its products on Ameen.

- is accountable for providing the products listed on Ameen.

 

  1. Intellectual Property:

Ameen and all their contents, features, and functionality (including but not limited to all information, software, text, displays, images…) are owned by Ameen. Its licensors, or other providers are protected by the Lebanese intellectual property, trademark, copyright, patent, and other intellectual property or proprietary rights laws.

 

  1. Users Feedback:

The feedback is intended to enable Us and the Service Provider to benefit from the collection of Reviews for education and enhancement of the Services.

The Users are given the opportunity to provide an honest review regarding an actual experience they have had in engaging with Ameen. Accordingly, in order to provide any review, you must comply with the review requirements and satisfy the following criteria:

You must be a natural person;

You must not have any personal interest that represents a conflict of interest with other User(s) for which you will provide a review;

Your review must be based on your personal experience in purchasing or providing a Service;

You must provide valid and current contact information to enable us to communicate with you, which we will manage according to our Privacy Policy; and you guarantee the truthfulness of your review.

 

  1. Prohibited Activities:

The User may not access or use Ameen for any purpose other than that for which we make Ameen available. Ameen may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Ameen.

 

  1. As a User, you agree not to:

Make any unauthorized use of the application, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses or fake information.

Cause harm or liability to other User(s), third party or to Ameen:

If there are objective and concrete reasons to believe that any of your content (1) breaches these Terms, service-specific additional terms, or policies, (2) violates applicable laws, or (3) could harm our users, third parties or Ameen, then we reserve the right to remove some or all of that content and/or the account in accordance with applicable laws.

 

  1. Termination of Accounts

Ameen will be entitled to suspend the fulfilment of the obligations, or to terminate/ delete the account, if the User does not completely, or does not correctly, fulfil the obligations under the Terms and Conditions and/or the Privacy Policy.

 

If, after termination of the account, there is information coming to the knowledge of Ameen on the basis of which Ameen has a well-founded fear that the User will not fully or not correctly perform the Service, Ameen will only suspend or terminate the account insofar as the shortcoming justifies this.

 

  1. Limitation of Liability

Ameen will not be liable for any and all damages arising out of or in connection with offering or using the Services or the Terms and Conditions or the Privacy Policy.

In no event will Ameen have any liability to you or to any third party for any lost profits or revenues or for any indirect, special, incidental, consequential, cover or punitive damages however caused, whether in contract, or under any other theory of liability, and whether or not Ameen has been advised of the possibility of such damages. The foregoing disclaimer will not apply to the extent prohibited by applicable laws.

The User and Ameen agree that: (i) the mutual agreements made in this Section reflect a reasonable allocation of risk and (ii) that each party would not enter into these Terms without these limitations on liability.

Ameen does not refer to you or endorse or recommend any particular Service Provider. Ameen shall not be liable for any wrongful acts or omissions from the Service Provider with respect to the messages or to the Service Provider’s consultations and Services.

Ameen reserves the right at any time, without previous notice, for any or no reason and the User agrees to hold the Company free from any liability whatsoever in case the Company:

- refuse service to anyone,

- modify and discontinue any portion or all of the services,

- restrict, suspend, terminate, and delete Users’ accounts.

 

  1. Indemnification:

The User will, upon request from Ameen, defend Ameen, and its respective officers, directors, employees, as well as agents against any and all third-party claims, actions, suits, proceedings, and demands, and will indemnify and hold harmless Ameen from and against all liabilities, losses, damages, penalties, judgments, awards, settlements, costs, and expenses including, without limitation, attorneys and other professional fees incurred in any investigation or defense thereof, arising from, in connection with, or relating to the User(s) actions or omissions that constitute a violation or breach of these Terms and/ or the Privacy Policy, including the feedback or any of the warranties or representations made by the User herein.

 

  1. Severability:

If any part, term or provision of these Terms and Conditions is held to be illegal, in conflict with any law or otherwise invalid, the remaining portion or portions shall be considered severable and not be affected by such determination, and the rights and obligations of the parties shall be construed and enforced as if the Agreement did not contain the particular part, term or provisions held to be illegal or invalid.

 

  1. Force Majeure

Ameen shall not be liable by reason of any failure or delay in the performance of its obligations hereunder for any cause beyond its reasonable control, including but not limited to electrical outages, failure of Internet service providers, riots, insurrection, war (or similar), fires, flood, earthquakes, explosions, and other acts of God.

 

  1. Payment Method 

All User benefiting from the Services should settle all amounts requested by Ameen after completing the Services.

Once the Service Provider has completed the assigned job, the Service Provider shall invoice the Client through Ameen.

All payments must be made in full, and any missing amount will result in the payment being considered null.

All payment shall be made through bank transfer via Areeba Apir or in cash to the Service Provider. In the event the payment is made in cash, the Service Provider shall reimburse the paid amounts to Ameen within 48 (forty-eight) hours of such payment through Cash United.

All payments must be delivered in the United States Dollars (USD) currency. Any payment made in any currency other than USD is unacceptable and void.

If any issue arises in regard of any bank transfer, User shall contact customer service to follow up with the bank transaction.

 

  1. Applicable law and competent jurisdiction

The Lebanese Law applies to these Terms and Conditions.

All disputes will be submitted to the Lebanese courts of competent jurisdiction.
